James and Jarrod Bacon arrived at the Surrey Provincial Court house today. Clad in bright orange jumpsuits they stood before Judge Jean Lytwyn thursday to hear her decision.
Judge Lytwyn found James Bacon guilty on 10 counts of gun possession charges. However in the same charges Jarrod Bacon was found not guilty. An announcement that left James Bacon in smile. Judge Lytwyn concluded that although Jarrod’s DNA was found on the weapons, the evidence was too small and inconclusive to convict him.
Evolution’s Christa Dao spoke with Crown Council Niel Mckenzie who had hoped for another decision. He said, “We respect the courts decision and the judge had to make a number of decisions in respect to the strongest contested points in the case. Obviously as her decision sets out she was not prepared to draw the inference of the crown side in relation to Jarrod.”
The charges came to both of them after Jamie Bacon was shot at on April 13, 2007. Police investigated and found a secret compartment the Chevrolet Suburban. That compartment contained four semi-automatic guns and five other loaded pistol magazines.
